SRK Music Sends Legal Notice for Infringement of Copyright vest in song ‘Nasha Sir Pe’

SRK Media Entertainment has sent legal notice for infringement of copyright vest in song ‘Nasha Sir Pe’ used in the feature film “Badshaho” as “Piya More”. The legal notice was sent to T-Series Production Golden Chariot Studio, Mr. Bhushan Kumar (Director), Mr. Krishan Kumar, Vertex Motion Pictures Pvt. Ltd., Mr. Milan Luthria (Director), Mr. Ankit Tiwari, and Mr. Manoj Muntashir. SRK Media Entertainment is in the profession of purchasing audio rights from the producers/creators/performers etc and distribute it through various mediums.
It sent a legal notice to the aforementioned people claiming that their copyright content was used by them illegally without permission. The notice claimed that the SRK Media owns music right of the movie “Dee Saturday Night” from M/s. Patlla Productions, through its sole proprietor Mr. Jai Prakkash. It read that one of the song “Nasha Sir Pe” is also a part of the mentioned movie and also the part of the agreement.
SRK Media Claims illegal copyright infringement of ‘Nasha Sir Pe’
As per SRK Media, they own the song titled “Nasha Sir Pe” as per the agreement with the producer of the movie “Dee Saturday Night” and the owner of the copyright vesting in the music and its songs under the Copyrights.
It claimed that without the knowledge of the copyright holders, they have illegally used the song “Nasha Sir Pe”, without any intimation to or knowledge.
It claimed that by adopting the identical song owned by them, they are infringing the rights of them. It stressed that they were violating the Copyrights Act. by using the identical song as that of their song. It also warned that it will sue for infringement of the copyright in the song under the Copyrights (Amendment) Act, 2012.
It claimed that they did not give any credit or compensation to them for the song they have copied. It said that it has suffered a great loss and damage in his profession and business due to the violation of the copyrights. It said that it was pure piracy of Copyright under the Copyrights (Amendment) Act, 2012 which is a criminal offence punishable with imprisonment for a term which shall not be less than Six months but which may extend to 3 years and with fine which shall not be less than Rs. 50,000/- but which may extend to Rs. 2 lakhs.
For now, the other party was asked to stop telecasting or promoting the song under the ‘Piya more’ title. Compensation was asked to be paid for the damages caused.
